The Dream Act

Understanding DACA with Help from Our Carrollton Immigration Lawyers

The Deferred Action for Childhood Arrivals (DACA) program was created by President Barack Obama to protect certain immigrants from deportation and allow them to get temporary work permits. The DACA program has allowed some undocumented immigrants to secure a temporary work permit. At Christensen P.C., our attorneys can help you navigate changes to this program under the current administration.

If you have questions about how the Dream Act affects your status, please call (972) 597-1460 for a consultation.

Qualifying for DACAundefined

In order to qualify for DACA, you must have arrived in the United States prior to 16 years of age, lived in the country continuously since June 15, 2007, and satisfied an educational requirement. In addition, DACA recipients cannot have been convicted of a felony, significant misdemeanor, or pose a threat to public safety or national security.

Renewing Your DACA Application

The program was terminated by President Trump in September of 2017, leaving the status of recipients in question. However, a court injunction on January 13, 2018, allows individuals to renew their status, if they meet certain requirements.

You may be able to renew your immigration status under DACA, as long as you:

  • Previously had a DACA application approved
  • Have a current valid DACA
  • Had DACA that expired less than a year ago
  • Have continuously resided in the U.S. since your most recent DACA request
  • Have no convictions of a felony, significant misdemeanor, or three or more misdemeanors

After DACA renewals are approved, the benefits are the same as before the program was canceled. It should be noted that the court injunction has resulted in the program remaining in place at the present time. However, we cannot guarantee that this policy will remain in effect under the current administration. For this reason, we encourage you to contact our office to consult with our Carrollton immigration lawyers as soon as possible.

“I’ve been working on various immigration requirements for the better part of 10 years now & I can say with absolute certainty that Nathan is the best lawyer I’ve encountered within that time (and I’ve met a few). Right from the beginning he made sure I understood my rights and the road ahead, providing a step-by-step guide to make my applications go as smoothly as possible. He was always available to meet and discuss my case, while also staying in contact via email/phone if I couldn’t make it in. Thanks to Nate I now have my Permanent Residency established and I look forward to returning to him in the near future to begin applying for Citizenship.”
