Provisional Waivers Lawyer in Carrollton

Reducing the Time Families Are Separated

Under the Obama Administration, the immigration process for many immigrants married to U.S. citizens and permanent residents changed. This enabled immigrant certain visa applicants who are qualified immediate relatives of U.S. citizens and lawful permanent residents to apply for a provisional unlawful presence waiver before leaving the U.S. reducing the time they have to spend away from their families. At Nathan Christensen P.C., our attorneys in Carrollton assists clients with this process and we are very good at it.

Changes to the Provisional Waiver Processundefined

Under the old process, immediate relatives were unable to apply for a waiver until after an interview for an immigrant visa abroad and a Department of State consular officer had determined they were inadmissible to the U.S. The waiver could not be submitted until after the interview and people often waited months, or even years, for a decision. In the meantime, the relative was required to remain outside of the country and away from the family.

The new process covers relatives of U.S. citizens and residents, including:

  • Spouses
  • Children
  • Parents

It allows qualified people to apply for a provisional waiver before leaving the country for an immigrant visa interview abroad. This process has shortened the time that U.S. citizens and residents are separated from family while waiting to obtain immigrant visas.

Bringing Families Together

Spouses, children, and parents of U.S. citizens and permanent residents are now eligible to apply for the new provisional unlawful presence waiver prior to going abroad for an interview. This reduces uncertainty for families and shortens the time they are kept apart. If you are married to a citizen or permanent resident of the United States, this is a good time to start the immigration process. Our immigration lawyers in Carrollton can answer your questions and guide you through the process.

“I’ve been working on various immigration requirements for the better part of 10 years now & I can say with absolute certainty that Nathan is the best lawyer I’ve encountered within that time (and I’ve met a few). Right from the beginning he made sure I understood my rights and the road ahead, providing a step-by-step guide to make my applications go as smoothly as possible. He was always available to meet and discuss my case, while also staying in contact via email/phone if I couldn’t make it in. Thanks to Nate I now have my Permanent Residency established and I look forward to returning to him in the near future to begin applying for Citizenship.”
