Changes to the Provisional Waiver Process

Under the old process, immediate relatives were unable to apply for a waiver until after an interview for an immigrant visa abroad and a Department of State consular officer had determined they were inadmissible to the U.S. The waiver could not be submitted until after the interview and people often waited months, or even years, for a decision. In the meantime, the relative was required to remain outside of the country and away from the family.

The new process covers relatives of U.S. citizens and residents, including:

  • Spouses
  • Children
  • Parents

It allows qualified people to apply for a provisional waiver before leaving the country for an immigrant visa interview abroad. This process has shortened the time that U.S. citizens and residents are separated from family while waiting to obtain immigrant visas.
